I hda a favorble IME,ordering a cervical MRI on 02sept08, still no word from the new adjuster Nancy Shields,from ACE casualty,she won't return calls or approve MRI.I have also emailed Fox 25,channel 7,Gov Patrick,Sen Kennedy,and congressman Lynch, with any luck someone will step up to the plate and hold these Insurance Co's accountable

10April06  Working down at Clean Harbors Ct, I was putting a load of waste onto truck for transport to Clean Harbors Ont., The Roll off can was leaking, which contained solids laced with cyanide. I grabbed a 6' pipe and cranked down the chain binder which broke, and I took full force of the leverage. I loaded and took off for Canada, figuring I wrenched my shoulder. Tom Conley witnessed the accident, and reported it; I also reported it via Satcom enroute.  Worked another 10 days and got sent home (discoloration of shoulder) by my boss. I contacted my Primary Phys.(Dr Eric Johnson) and could not see him for 2weeks, so I went to Jordan E/R on the 21st. Had x rays and MRI done, by Dr Ziblski. They found a full thickness rotator cuff tear and a torn Bicep.
        2June06 Dr Stanwood did surgery; Arthroscopic subacromial decompression,Artho distal clavicle resection, Artho rotator cuff repair, Artho glenohumeral debridement and open biceps tenodesis. Post -op I was referred to Dr Singla at Spine and Pain Inst of New England underwent suprascapular nerve blocks without relief. 19 visits with Jordan (Halifax) PT.  During this time I was assigned a Nurse case manager Shirley Brewer, do not ever trust her or her position, they work for the Insurance Company, even though they state they are working for you and you're best interest.
         15Sept06 Dr Stanwood preformed another surgery, for adhesive capsulitis and lysis of adhesions. R-cuff was intact at that time. I went home and I was put into a CPM (torture) chair to keep the shoulder moving. Since coming home from Jordan I could not eat/drink or retain anything for 12 days, I went back to Jordan E/R on the 27Sept06 and sent home. Passed out on 28Sept06 got up and drove myself back to Jordan E/R, they admitted me asap. I caught a C difficle infection during surgery. Got out a week later.
Back to Halifax PT for another 20 visits.
          OCT06 Saw Dr Singla for a suprascapula injection ,no results, At this time I was called by the USMC, to see if I would volunteer for reserve duty ,I said yes and took my physical at Newport Naval Hospital (RI), failed due to my shoulder injury, the Gov't does not want to own it. Also Referred to Dr Ian Paskowski /Eastern Shore Chiro, in which I saw results by breaking up the adhesions, released from jordan PT due to minimum results. 0n 31oct06 I went back to Dr Stanwood with Nurse case manager Shirley Brewer, and wanted a 2nd opinion/IME by Dr Holvacs or Dr Gary Pearlmutter, I agreed,Dr Holvacs had a 6month wait, Dr Singla knew Dr Pearlmutter personally and got me in 2 weeks. Dr Stanwood also cleared me at this time to do light duty. Clean Harbors Jen Morrissey@ human resources contacted me about office work, I had no problem, but I needed transport to and from due to the meds, which at that time was Lyrica, Flexerall, Percocet, Dilaudid and Vikoden 750mg. In a 3way conversation with Jen Morrissey and NURSE Shirley Brewer, they deemed it "OK FOR ME TO DRIVE ON THESE MEDICATIONS". I refused. I called Dr Stanwood asap and asked him if he said it was ok to drive, "NO WAY,did I say that".Because of that lie by Nurse Shirley Brewer, nurse case managers are not allowed at Dr Stanwoods office. Clean Harbors would not transport me to work.
      30Nov06 Saw Dr Gary Pearlmutter for IME/2nd opinion, recommended a Arthogram MRI to Ace Casualty Ins Co. Same day I was served by Claen Harbors and ACE Casualty, to eliminate all benifits.
  Forced to a Hire ATTNY; Bruce Lipsey (Hanover Ma) 8 Months AFTER INJURY
       Feb 07 Started DIA hearings.
    09FEB07 Called by Ma National Guard to volunteer for Reserve Duty in a Nuclear Bio Chem response team. Took Physical at Manchester NH Vet Hospital and failed due to shoulder injury, the state did not want to "own that shoulder injury".
    16FEB07 Got approval and had MRI/Arthogram done at MGH, and rushed back after due to reaction to dye injection. ALL PERSCRIPTIONS have been DENIED BY LISA RUSSO/ACE CASUALTY
     04APRIL07, 3RD Surgery done at MGH west by Dr Gary Pearlmutter; Revision acromioplasty, Arthoscopic Rotator Cuff repair, revision clavicle resection and arthoscopic debidment. At this time Clean Harbors cancelled my health insurance. Dr Pearmutter wants follow up and PT to start in 4weeks. DENIED by ACE Casualty. Back to DIA.
     07Aug07 Insurance IME with Dr Nason C Burden (Taunton Ma) Found to be Temp Disabled and to keep following up with Dr Pearlmutter. Approved by DIA to start PT for month of August ,5 MONTHS AFTER SURGERY.
      30OCT07 Re-approved for 8 more weeks of PT
     12DEC07 2ND IME; Insurance Co IME/ Dr James McGlowan (Quincy, Ma), found to be still temp disabled with major shoulder issues. I have not been paid for 60 days
      15Jan08 Lost my house in Bridgewater; I could not afford to keep it on partial disability;
Sold it for 55k less than I purchased. CHASE Bank also promised that if I could sell by 31 jan08 they would not report anything on my credit (they lied), because I was taking the loss and making sure they got paid off in full. They did! I did the right thing and they screwed me. They did not care about the injury.
       Feb07 I lived in my Pickup Truck with my 100lb dog.  Back to DIA
       March08 Dr Paerlmutter released me to Dr Singla for follow up,Dr Singla recommended a Cervical/Shoulder MRI to be able to do nerve blocks. DENIED BY JULIA COCO @ACE CASUALTY " the NECK has absolutely NOTHING to do with the shoulder" Dr Singla also prescribed stronger lyrica and Lydocaine patches DENIED BY JULIA COCO /ACE CASUALTY. I had to go to Independent Prescription Services, who will then go after ACE CASUALTY. I continue to see Dr Ian Paskowski to keep my shoulder moving.
       June08 Back to DIA Ace ordered to pay out of pocket and medical bills. ACE refuses to obey the JUDGES ORDER, they still have not paid.
       AUG08 DIA approves PT16wks 2xp/wk, Dr Paskowski recommends Adrian Blint at Baystate PT,(Plymouth) best thing that could of happened. I have gained strength and movement, but during visit Adrian tilted my head back I got dizzy, started blacking out and puked. He and Dr Paskowski feel that something IS going on with the neck/shoulder, I can stand and sit in place and not black out, they feel that when my head is tilted backwards it is shutting off oxygen and blood flow to the brain.
       Sept08 I am picking up records from Dr Pearlmutter's office at MGH and run into him by accident, I explain what's going on and where the pain is. He wants me to see him again after IME is done. I have 4TH IME done with Dr Feldman at Sturdy Hosp (Attleboro) and he recommends cervical MRI and re-visit with Dr Pearlmutter. Now I am waiting for approval from ACE CASUALTY for the MRI. Still my shoulder is junk and in pain constantly. I have been given permission to do light duty, not using my R(dominant) arm, try to find a job, between other Insurance co's they do not want to OWN my shoulder, and just mention DIA, sorry can't use you! So I do try to do little things around the house, I'll try to rake, shovel etc..But only last 15/20 minutes, then it's back to ICE. After therapy I am usually junk for a solid 2 days.
       In Summary, I've been lied to and about by Jen Morrissey(clean harbors), Lisa Russo(ACE Casualty),Julia CoCo(ACE Casualty), Nurse Case Manager Shirley Brewer (utilization review for ACE Casualty),ATTY Joseph Bertrand ( representing ACE and CLEAN HARBORS) Woburn, MA. I have PI's following me all over (I really don't care),they sit in front of my house, down the street, around the corner, follow me to PT and Dr's appointments. After 3x surgeries you would think THEY would stop wasting money, speed things along so I can return to the workforce and regain myself respect and get on with my life.
I do realize that some abuse the system, but 3 surgeries? Come on wake up, you do not need to be a rocket scientist to figure it out. Oh that’s right I have deal with Insurance companies, their adjusters (who disobey the MA State court orders, if I did that I would be in jail) their lawyers (no comment) and the P.I.s. The only ones who can change the policies are our gov't reps, I have complained to Sen Kennedy, Con Lynch, to no avail. I have applied to social security denied, low cost medical denied (I make $13 per wk above poverty level).
I guess it really comes down to the Insurance Co's do what/when they want, disobey judges orders, generally run the country, why have politicians? NOBODY LISTENS or CARES
